Kaekani Pty Ltd. processes personal information in accordance with the Protection of Personal Information Act (POPIA, Act No. 4 of 2013). This policy explains what we collect, why, and the rights you have over your data.
Introduction
This Privacy Policy describes how Kaekani Pty Ltd. (“Kaekani”, “we”, “us”) collects, uses, stores, shares and protects personal information in connection with our SMART property and broadband consulting services. We process personal information in compliance with the Protection of Personal Information Act, 2013 (POPIA) and applicable South African law.
By engaging with us — whether by submitting our contact form, corresponding by email, or entering into a consulting engagement — you acknowledge the practices set out in this policy.
Information We Collect
We only collect personal information that is necessary for the purpose for which it is being processed. The categories of information we may collect are:

- Contact data — email address, telephone number, postal or physical address of the property under assessment.
- Communication data — content of correspondence and project notes you send to us.
- Technical data — anonymised log information from our website (IP address, device, browser, referring URL).
- Project data — site plans, electrical and civils data, vendor / ISP information and assessment outcomes shared with us under engagement.
How We Use Your Information
We use personal information for the following purposes:
- Conducting SMART property assessments and feasibility reviews.
- Delivering consulting, project management and ISP-coordination services under an executed engagement.
- Managing the client relationship — scheduling, reporting, administration and invoicing.
- Compliance with our legal, regulatory and professional obligations.
Legal Basis for Processing
We process personal information on one or more of the following legal grounds:
- Performance of a contract — to deliver services you or your organisation has engaged us for.
- Legal obligation — to comply with applicable laws and regulations, including POPIA.
- Legitimate interests — to operate, secure and improve our practice, where those interests are not overridden by your rights.
- Consent — where you have given specific consent for a clearly stated purpose. Consent may be withdrawn at any time.
Data Sharing
We do not sell personal information. We share it only with parties who are necessary to deliver the engagement — typically Internet Service Provider (ISP) partners, vendors and sub-contractors — and only under written confidentiality obligations consistent with this policy.
We may also disclose personal information where required by law, court order, or a regulatory authority with proper jurisdiction.
Data Retention
We retain personal information for as long as necessary to fulfil the purposes for which it was collected, satisfy legal and audit requirements, and resolve disputes. As a default, project records are retained for five (5) years from the date of project completion, after which they are securely deleted or anonymised.
Your Rights Under POPIA
Under POPIA, you have the right to:
- Request access to the personal information we hold about you.
- Request correction of information that is inaccurate, misleading, outdated or incomplete.
- Request deletion or destruction of personal information we are no longer authorised to retain.
- Object to the processing of your personal information on reasonable grounds.
- Lodge a complaint with the Information Regulator of South Africa if you believe your information has been mishandled.

Security
We apply appropriate technical and organisational measures to protect personal information against unauthorised access, accidental loss, alteration or disclosure. Measures include access controls, encrypted transport for client correspondence, secure storage of project files, and confidentiality undertakings with all personnel and sub-contractors.
No method of transmission over the internet is 100% secure. Where we become aware of a security compromise that materially affects you, we will notify you and the Information Regulator in line with POPIA.
Cookies
Our website uses functional cookies only — they are required for the site to operate and to remember preferences such as your selected colour theme. We do not use advertising cookies, behavioural targeting or third-party analytics that profile individuals. You can disable cookies in your browser settings; some features (e.g. theme persistence) will not function without them.
